Kenya’s Free Speech Battle: Author Arrested Over Unauthorized Biography of President’s Daughter

In a case sparking widespread debate, Kenyan free-speech advocates and legal experts have condemned the arrest of Webster Ochora Elijah, a 25-year-old author charged with impersonation for publishing an unauthorized biography about Charlene Ruto, daughter of Kenyan President William Ruto. The book, Beyond the Name: Charlene Ruto and the Youth Uprising, has ignited controversy, with critics arguing that criminalizing authorship threatens Kenya’s democratic values.

Charlene Ruto, a prominent public figure often compared to Ivanka Trump, reported the author to the police, alleging he misused her name by writing the book without her consent. Speaking to journalists, she emphasized that the issue was not the book’s content but the lack of permission, describing it as part of a “bad culture” in Kenya where names are misused without accountability. “The gentleman never approached me with a suggestion to write a book on my behalf, and for me, that’s a misappropriation of my name,” she stated.

Elijah, who pleaded not guilty, was arrested on Tuesday and released on bail. The charge sheet accuses him and others, who are yet to be charged, of publishing the book on or before May 22 with intent to defraud. However, the book, which has limited distribution, has not been criticized for its content, and Elijah’s legal team insists his actions do not constitute a crime.

Prominent voices have rallied in defense of the author. Lawyer Willis Otieno called the prosecution a misuse of “state machinery in defense of fragile egos.” Literary critic Mbugua Ngunjiri argued that writing an unauthorized biography is not illegal, citing a 2014 biography of former President Uhuru Kenyatta as a precedent. “A million writers can write ‘her book,’ and it will be perfectly legal unless there’s misrepresentation,” Ngunjiri posted on Facebook.

Lawyer Kennedy Mong’are, part of Elijah’s defense team, noted that he has previously written books about public figures like Raila Odinga and Donald Trump without issue. Another lawyer, Evan Ondieki, emphasized that high-ranking figures like Charlene Ruto should expect public scrutiny. “You cannot be so thick-skinned that the use of your name becomes an offense,” he said.

The case comes amid growing concerns over free expression in Kenya. Recently, software developer Rose Njeri was arrested for creating a tool to oppose the government’s finance bill, charged with cyber-crime, and released on bail. Njeri thanked Kenyans for supporting her against what she called a “ludicrous” arrest. In April, a teacher was also charged for impersonating another of Ruto’s daughters, June Ruto, on social media.

Charlene Ruto, a high-profile figure who has attended international forums and public events, previously denied using public funds for her activities as the “First Daughter.” The ongoing legal battles have amplified fears that Kenya’s democratic freedoms are under threat, with critics arguing that such prosecutions undermine the right to free speech and public discourse.
